Karti and his chartered accountant will now reportedly be interrogated together. Bhaskaraman was arrested by the Enforcement Directorate on February 16 and has been sent to judicial custody till March 22.
The bench said it will pass orders directing the high court to entertain the petition of Karti and pass the interim order once a proper application is being moved.
Besides, Directorate of Enforcement (ED) had registered a money laundering case against Karti in May 2017 for his role in facilitating clearance from the Foreign Investment Promotion Board (FIPB) for INX Media Ltd and its Directors, Peter and Indrani Mukerjea both accused in the murder of Sheena Bora and others.
He further stated that his client was neither a director nor a member of Advantage Strategic Consulting Pvt. He (Karti) is not the only person facing a case under the Prevention of Money Laundering Act.
However, a CBI court extended his custody in the INX media case for three days. The counsel argued that the CBI is only harassing the accused by seeking further custody and does not have any new material to confront him with.
Karti has been in the custody of the CBI since his arrest on February 28. However, on the intervening night of March 6 and March 7, he was shifted to a cell where guards were also sleeping the same night. "CBI has to justify remand every day and every minute", Singhvi said on behalf of Karti. As a result, the accused's blood pressure shot up and he faced medical problems, he said. "Vast voluminous documents have been recovered which have some direct link hence it will be necessary to confront Karti with this", said ASG Tushar Mehta, appearing for the CBI.
It sought quashing of the probe by the ED, alleging that it was contrary to the procedure established by law and violates Karti's fundamental rights.
The apex court had asked Karti, who is in CBI custody in connection with the INX Media case, to approach Delhi High Court for interim relief in INX Media money laundering case. This may involve questioning of Chidambaram himself, they said.
Karti was produced after the expiry of his three-day police remand before special judge Sunil Rana who posted the hearing on his bail plea on March 15.
Justice S Ravindra Bhat also made it clear that in case the special court grants Karti bail in the CBI case, which has registered a corruption case against him, the ED will not arrest him till the next hearing before it. However, the ED is planning to appeal in the Supreme Court against the HC order.
